Terms of Use

These Terms of Use ("TOU") constitute a binding agreement between you ("User") and HeadShotIQ, LLC. By clicking "I Agree" below to access or use HeadShotIQ's website, web application, or services (collectively, the "Services"), you agree to these terms. If you do not agree, you must not use the Services.

Services Provided

HeadShotIQ provides image-based analysis tools designed to offer interpretive insights regarding uploaded headshots. Outputs may include descriptive attributes, perceived age ranges, and character reference examples. HeadShotIQ does not provide agency referrals, casting services, employment opportunities, or audition listings.

AI Output & Service Limitations

HeadShotIQ's analyses are generated through automated systems and are inherently interpretive. Results are provided for informational and educational purposes only and should not be considered professional, casting, or career advice. All content and insights provided by HeadShotIQ are for informational and educational purposes only. The Services do not constitute professional casting advice, professional evaluation, psychological guidance, or legal recommendations. Any decisions made based on the information provided are solely at your discretion.

HeadShotIQ uses automated systems to analyze uploaded images and generate interpretive insights. Outputs are generated through algorithmic processes and may not reflect individual opinions, industry preferences, or real-world casting decisions.

HeadShotIQ may use trusted third-party AI service providers to process uploaded images and generate analysis outputs. These providers process images solely for the purpose of delivering the requested Services.

HeadShotIQ does not guarantee agency referrals, employment, auditions, representation, or casting outcomes. Casting decisions are inherently subjective and are made solely by third-party industry professionals.

AI-generated outputs are inherently interpretive and may vary between users, images, and sessions. Users are responsible for evaluating how to use any insights provided.

Nature of Outputs

HeadShotIQ provides AI-generated outputs that are inherently interpretive and may not be error-free or reflect every possible perspective. Results are intended for informational and educational use only.

User Responsibility

You are responsible for all content you upload or submit through the Services. You agree not to upload content that violates laws, including state, federal and international, third-party intellectual property or real property rights, confidentiality obligations, or any third-party contractual obligations.

Liability Waiver

To the fullest extent permitted by law, HeadShotIQ shall not be liable for indirect, incidental, consequential, punitive or reliance-based damages arising from use of the Services. At no point shall you be entitled to nor shall you seek to declare for injunctive relief in connection with your use of HeadShotIQ.

Updates to Disclaimer

We may update these Terms and related policies from time to time. Continued use of the Services constitutes acceptance of revisions.

User Responsibilities

Users agree to:

Upload only content they own or are authorized to use
Refrain from uploading unlawful or infringing material
Use the Services only as intended

Headshot/Image Uploads - User Rights & Consent

Users retain ownership of their uploaded images. By uploading an image, you represent that you own the image or have legal permission to use it. You grant HeadShotIQ a limited, irrevocable license to process the image solely for the purpose of providing the Services. HeadShotIQ does not use uploaded images for model training, resale, or redistribution.

By uploading images to HeadShotIQ, you agree that:

Uploaded images must not violate copyright, privacy, contractual, or third-party rights
You consent to the automated processing of uploaded images as necessary to deliver the Services
Uploaded images are processed securely and are not shared with third parties except as necessary to operate the Services

HeadShotIQ is not responsible for user-uploaded content and assumes no liability for images submitted without appropriate rights or permissions.

If you do not agree to these terms, you must not upload images to the platform.

Payment for Services

HeadShotIQ currently operates on a pay-per-use basis. Pricing and purchase options may change.

All purchases are final except where refunds are legally required.

Refunds

Purchases are final. Refunds are issued only when legally required.

Payment Processing

Payments are processed by Stripe, our third-party payment provider. HeadShotIQ does not store or have access to full payment card details. Payment transactions and related data are governed by Stripe's terms and policies.

Promotions and Discounts

Promotional offers, discounts, or trial features may be offered from time to time. Such offers are temporary, non-transferable, and subject to the specific terms presented at the time of the offer.

HeadShotIQ reserves the right to modify or discontinue promotional offers in its discretion at any time without prior notice.

International Users

HeadShotIQ operates from the United States. By accessing the Services from outside the United States, you agree that the Services are governed by the laws of the State of Louisiana, without regard to conflict-of-law principles. You further agree that any disputes shall be resolved in accordance with applicable U.S. arbitration rules as set forth in these Terms.

Updates and Notice Procedures

HeadShotIQ may update these Terms or related policies from time to time to reflect operational, legal, or regulatory changes.

Notice of Changes

Material changes may be communicated through reasonable means, which may include:

In-app notifications at login or during use of the Services

Continued use of the Services after notification of updates constitutes agreement, acknowledgment and acceptance of the revised Terms.

Effective Date

Unless otherwise specified, updates become effective upon the date of posting the related update. Continued use of the Services after updates constitutes agreement, acknowledgment and acceptance of the revised Terms.

User Responsibility

Users are responsible for reviewing the Terms periodically. If you do not agree with the revised Terms, you must discontinue use of the Services.

Intellectual Property

All HeadShotIQ trademarks, branding, software, and proprietary technology remain the exclusive property of HeadShotIQ. Users may not copy, modify, distribute, reverse engineer, or misuse any part of the Services. Nothing herein shall constitute a grant by HeadShotIQ of any license, rights or entitlements to the any of the intellectual property owned, licensed or controlled by HeadShotIQ.

Privacy and Data Protection

HeadShotIQ is committed to protecting user privacy and handling data responsibly. Uploaded images are stored and processed securely solely to provide the Services.

Limitation of Liability

The Services are provided on an "as is" and "as available" basis without warranties of any kind. To the fullest extent permitted by law, HeadShotIQ shall not be liable for any indirect, incidental, consequential, punitive or reliance-based damages arising from use of the Services. At no point shall you be entitled to nor shall you seek to declare for injunction relief in connection with your use of HeadShotIQ.

HeadShotIQ's total liability for any claim relating to the Services shall not exceed the amount paid by you for the Services giving rise to the claim.

Indemnity

You agree to indemnify and hold harmless HeadShotIQ, its officers, employees, and affiliates from any claims, damages, liabilities, or expenses arising from:

Your use or misuse of the Services
Your violation of these Terms, including spamming, harassment or other misuse of the HeadShotIQ platform.
Content you upload or submit
Any breach or failure to fulfill any of your obligations or responsibilities included in these terms.

Dispute Resolution

Any dispute, claim, or controversy arising out of or relating to these Terms or the use of the Services shall be resolved through final and binding arbitration administered by the American Arbitration Association (AAA) in accordance with its applicable rules.

Arbitration shall be conducted on an individual basis. Class actions, consolidated actions, and representative proceedings are not permitted.

These Terms shall be governed by the laws of the State of Louisiana, without regard to conflict-of-law principles.

Miscellaneous

These Terms of Use constitute the entire agreement between you and HeadShotIQ regarding the Services and supersede any prior agreements or understandings.

If any provision is found unenforceable, the remaining provisions shall remain in full force and effect. HeadShotIQ's failure to enforce any provision shall not constitute a waiver of that provision or any other rights. HeadShotIQ expressly reserves all rights afforded to it under law and equity.

POLICIES:

Privacy Policy

HeadShotIQ values user privacy. We do not sell, rent, or trade user data.

Uploaded images are used solely to operate and deliver the Services, including generating analysis outputs and maintaining your uploaded image library within your account. Users may request deletion of their account data by contacting support.

Image Processing & User Consent

1. Purpose of Processing

Uploaded images are processed solely to deliver the core features of the Services, including headshot analysis, role matching, and first-impression insights. Processing may involve trusted third-party AI service providers that act on our behalf to generate analysis results. HeadShotIQ does not use uploaded images for model training, advertising, or resale.

2. User Ownership & Permissions

By uploading an image, you represent that you own the image or have the legal right to use it. You consent to the automated processing of the image as necessary to provide the Services. Uploading images without appropriate rights or permissions violates these Terms and may result in account restrictions, removal of content or HeadShotIQ exercising any other rights remedies available under law and equity.

3. Storage & Retention

Uploaded images are stored securely and remain associated with your account until you delete them. You may delete images or your account at any time. Deletion removes images from your account and from active systems used to operate the Services. Certain information may be retained as required for legal, security, tax, or backup purposes in accordance with applicable laws and third-party service provider policies.

4. No Third-Party Sharing

HeadShotIQ does not sell, license, or distribute uploaded images to third parties. Images are processed only by systems and trusted service providers necessary to operate the platform.

5. Security Measures

We implement reasonable administrative, technical, and security safeguards designed to protect uploaded content from unauthorized access, alteration, or disclosure.

6. User Controls

Users may delete uploaded images or their account at any time through the Services.

What We Collect

Profile Information: When you create an account, we collect basic account information such as your email address and any optional profile details you choose to provide.
Headshots/Images: Uploaded images are processed and stored securely to provide the requested features. Images remain accessible within your account unless deleted.
Analysis Output: HeadShotIQ generates and stores AI-generated outputs associated with uploaded images. These outputs are interpretive, informational, and remain accessible within your account unless deleted.
Payment Information: Payments are processed by Stripe, our third-party payment provider. HeadShotIQ does not store or have access to full payment card details. We may receive limited transaction information necessary to confirm purchases.
Device & Usage Data: Technical information such as device type, operating system, app version, and usage diagnostics may be collected automatically to maintain and improve service performance.
Support/Communications: If you contact support, we may retain your contact information and message content solely to respond and provide assistance.
Optional Communication: If you opt in, we may send service-related updates or educational content. You may unsubscribe at any time.

How We Use Data

We use information you provide solely to operate HeadShotIQ, including processing uploads, enabling purchases, and responding to support inquiries.

All purchases are processed through our third-party provider (Stripe). We do not receive or store your credit card or banking details. We may receive limited transaction details such as a receipt ID, amount, and purchase confirmation from Stripe. Stripe's handling of payment information is governed by Stripe's own privacy and security policies.

Data Retention

Uploaded images and associated analysis outputs remain linked to your account until deleted. Residual copies may persist temporarily in backups or security systems as required for operational integrity.

Security

HeadShotIQ applies reasonable technical and organizational safeguards designed to protect user data. However, no method of electronic storage or transmission over the Internet can be guaranteed to be completely secure.

User Rights & Control

Depending on your jurisdiction, you may have certain rights regarding your account data.

Deletion

You may delete uploaded images, analysis outputs, or your account at any time directly within the Services.

Correction

You may request correction of inaccurate account information that you cannot update yourself by contacting privacy@headshotiqapp.com

Access

You may request information regarding data associated with your account by contacting privacy@headshotiqapp.com. Identity verification may be required prior to fulfilling requests.

Data Portability

Upon request, we may provide a copy of your account data in commonly used electronic format, where applicable.

Payments & Third Parties

Payments

All payments are processed securely by Stripe. Stripe's policies govern how payment information is collected, stored, and handled. HeadShotIQ does not store or have access to full payment card details. We may receive limited transaction information (such as purchase confirmations or receipt data) necessary to operate the Services.

Third-Party Service Providers

We may use trusted third-party providers to support hosting, storage, and security functions. These providers process data solely as necessary to perform services on our behalf.

Data Sharing

We do not sell, rent, or trade user data. Information may be shared only with trusted service providers as necessary to operate HeadShotIQ. These providers are permitted to use data solely to perform services on our behalf.

HeadShotIQ LLC applies reasonable technical and organizational safeguards designed to protect user data, including uploaded images and associated account information.

While we take appropriate measures to safeguard information, no method of electronic storage or transmission over the Internet can be guaranteed to be completely secure. Accordingly, we cannot guarantee absolute security.
